依据著作权法规定，简单照片为“从摄影或类似方式获得的人物、自然或社会生活的环节、元素或事件照片，包含复制具象艺术作品与电影剧照（著作权法第87条）。”

如果本影像符合简单照片的定义，于1976年以前出版，且没有于1989年3月1日前标注版权，则该照片在回溯日期起，于意大利不受版权保护，且在美国处于公有领域（美国法典第17编第104条）。
