司法機構

審判裁定機構

司法機關,又稱司法機構司法部門,是政府機構之一,工作就是維護法律、確保法律正確執行、解決爭議;但「司法」的具體定義和司法部門的權力在不同法制有些不同。

大陸法認為,司法是指法院或特定機關依照法定職權和程序,具體適用法律民事刑事案件進行聆訊審判

普通法認為,司法就是審判裁決。在普通法體制,只有司法部門具有對法律(包括憲法)的解釋權

位於墨爾本的聯邦法院大樓,是澳大利亞聯邦巡迴法院英語Federal Circuit Court of Australia澳大利亞聯邦法院澳大利亞家庭法院英語Family Court of Australia的墨爾本分院,以及澳大利亞高等法院不定期開庭的地方。

大陸法的司法 編輯

大陸法中,法院會對案件進行具體調查;法官會傳召證人,盤問證人、被告等。法院有解釋法律的權力,但不一定具有對法律的最終解釋權。

另外,檢察機關通常都是司法系統的一部份。

普通法的司法 編輯

普通法法制中,法院不會對案件進行具體調查。法官裁判官的角色只是確保原告人(在刑事案件中則是代表政府律師)和被告人能公平地提出自己的論據,並作出判決。如果被告人被控告的是嚴重罪行(如謀殺強姦等),有些地區(如香港英國美國)是由陪審團決定被告是否有罪,法官只負責決定處罰方式。在普通法系中,只有法院有解釋法律的權力,而法院對法律的解釋和判案,都對以後的同類訴訟有約束力,成為案例法

另外,檢控機關通常都是行政系統的一部份。

司法機構的職能 編輯

司法機構最主要的職能就是行使司法權,即通過公共強制力維持社會秩序,進行利益仲裁,在有些國家也包括對憲法和法律的解釋權。

司法機構根據法律審理案件,解決法律衝突。遠東法系強調在對爭端和法律衝突裁決時注重社會影響,維持社會穩定。而西方法系,則更為認可個人和團體在對抗性的司法過程中勝訴[1]

司法權由法院履行。有些國家設有檢察機關行使司法監督權。
